Islam Khan has recently been granted permission to appeal to the Court of Appeal in the immigration case of BH Ghana, permission was given by Lord Justice Moses on 4 July 2013.

This is an important immigration case that raises a compelling reasons that has wider affect on article 6 (fair trial rights).

The facts are:

  • Whether or not the Secretary of State can adduce third party evidence without giving the person affected by that evidence the opportunity to address it;
  • When there is conflicting evidence what is the test to be applied in immigration cases as to ensure which one is to be acceptable.
