Mark Stevens in CCTV success

Following a four handed trial at Snaresbrook Crown Court on an indictment containing allegations of wounding with intent and violent disorder Mark successfully made an abuse of process argument regarding lost CCTV. This resulted in the proceedings being stayed.

The case alleged that Mark's client along with two others violently attacked a civilian witness and another co Defendant with knives outside Newham College. There were a variety of witnesses that the Crown relied on. During the trial process it was discovered for the first time that the Crown had previously in their possession CCTV which could have covered the incident. This had now been lost. Legal argument was made by Mark on the Court of Appeal authorities Ebrahim and Mouat as well the authority of Northward. The Court upheld the submissions made by Mark which resulted in the proceedings ending for Mark's client.
