Experience
Kevin has been led on numerous occasions by Queens Counsel, he has been instructed as leading counsel and was recently instructed as counsel alone to successfully represent a client charged with murder.
As an experienced advocate, he has an excellent reputation and his advice is often sought by other counsel and solicitors. He is respected as a fighter and as someone who always exhibits sound judgment which is combined with a sharp legal mind. Those who instruct him are always impressed with his client care skills and attention to detail. His practice and reputation is such that he is instructed in cases in London, Luton, Cambridge, Liverpool and Manchester.
The types of cases he defends vary, but are obviously weighted towards the top end of the criminal bracket. His cases have recently included bombing cases, hoax bombing cases, the first ever prosecution brought against a defendant charged with causing death by an uninsured driver and the largest ever fraud committed against the NHS by the use of ghost workers.
Notable Cases
His murder cases have included the infamous Blue Lagoon murder, the victim having been tortured and his body dismembered before disposal in the Blue Lagoon where it remained undiscovered for nearly a year. Drugs cases have included defending in a case where the defendant was caught in possession of 38 kilos of heroin at almost 100% purity. Kevin tested the extensive probe evidence, for which he has particular expertise which resulted in an application to dismiss the case. Operation Panther was a drugs case which involved the discovery of very large quantities of cannabis, cocaine and various mixing agents at an industrial unit in Essex. During the first trial the prosecution introduced crucial cell site phone evidence halfway through their case. Following extensive legal argument the trial was adjourned to allow proper analysis of the phone evidence by the defence. A retrial followed which, thanks to the efforts of counsel, exposed the phone evidence to be fatally flawed in a number of areas and resulted in the unanimous acquittal of the defendants. This was followed by an order against the prosecution for defence costs for the first trial, to be paid directly out of the CPS budget.
As an example of how Kevin does not take the easy option if it is not in the interests of his client he recently defended a man who was charged with GBH, false imprisonment and burglary along with 5 other co-defendants. The case included extensive forensic and photographic evidence. The sole victim, who had since died provided a statement (in which he named the defendant) which was read to the jury. Of the five co-defendants one had the case against him dropped due to serious ill health, the remaining co-defendants offered pleas to simple burglary, which the prosecution accepted. Kevin was left with his alcoholic client alone in the dock facing a week long trial. The jury, having heard all the evidence from the prosecution and the defence unanimously acquitted his client.
Appellate Work
Kevin has appeared in the appeal courts on numerous occasions and recently successfully appealed the case of R v Costello which resulted in a much needed review of the law dealing with issues surrounding the length of sentences imposed on defendants who have committed further offences during their licence recall period.
Memberships and Professional Associations
Kevin plays an active part in the courts he attends by regularly appearing at court users meetings representing the independent bar.
A barristers independence is something he believes passionately in, as it ensures that the highest standards are maintained and allows counsel to concentrate on their task of assessing and if need be testing the evidence brought against their clients. To this end he is a member of his local Bar Mess, the Criminal Bar Association he also sits on the South Eastern Circuit committee and was invited to sit on its executive committee. He has recently advised and contributed to the circuits response to the governments "Breaking the Cycle" of offending paper.
