Reported cases

R v Prosser [2008] All ER (D) 214 (May)

Successful appeal – sentence of Imprisonment for Public Protection (IPP) quashed and replaced with a determinate sentence for offences involving indecent images.

 

Appeal Courts work / Judicial Review

Andrew provides specialist advice for the victims of miscarriages of justice to both the Court of Appeal (for an example, see Prosser, above) and the Criminal Cases Review Commission. Andrew also specialises in Judicial Review matters, including a matter where he maintained that an Anti-Social Behaviour Order (ASBO) was flawed and the local authority removed the ASBO; and another wherein Andrew secured a prisoner’s release when he was detained unlawfully.

 

Fraud

R v Harris

Ten-handed conspiracy to steal from Superdrug.

R v King

‘Loan shark’ accused of consumer credit act offences, money laundering, blackmail (to be heard);

R v Smith

Company director accused of facilitating major fraud through sale of computer components, funds were obtained by a fraudulent factoring arrangement. On confiscation, the alleged benefit was halved and the available assets reduced by 80%;

R v Watts

Company director accused of stealing company funds through the creation of false invoices.  Convicted but given community sentence;

R v Duffin

Employee accused of ‘hacking’ computer system of company to steal from tills.  Acquitted; and

R v Shelton

Drug importer (guilty plea).  On confiscation, both the benefit and available assets were reduced by half.

From November 2008 to June 2009 Andrew was on secondment with the Asset Forfeiture Division (AFD) of the Revenue and Customs Prosecutions Office. He advised on various matters including Carousel Frauds, Smuggling cases (gold, tobacco, drugs) and other frauds. He dealt with international evidence, contempt of court, restraint proceedings and orders and management receivership proceedings and orders. He also advised on insolvency, jurisdiction and Family law. Following the secondment, Andrew was appointed to the Attorney-General’s list of advocates.

Rape of 14 year old girl. Guilty plea;

R v Madden

Indecent Assault. Acquitted following retrial; and

R v King

Deaf and dumb patient sectioned under mental health act accused of indecent assault. Acquitted.

 

General Crime

R v Robinson

Alleged member of ‘Black Mafia’ gang accused of violent disorder together with six others. Acquitted.

R v Flower

Charges of witness intimidation and Actual Bodily Harm (ABH). Acquitted.

R v Ali

Alleged gangster accused of Blackmail, and supplying class A drugs. Guilty plea, lenient sentence.

R v Vassell (S)

Alleged gangster accused of armed robbery. Acquitted.

R v Vassell (G)

Alleged gangster accused of possession of ammunition and supply of class A drugs. Acquitted.

R v Tucker

Man accused of domestic violence, wounding with intent on partner. Acquitted.

R v Khan

Alleged gangster accused of blackmail, false imprisonment and ABH. Acquitted.

R v Chalkwright

Drug addict accused of robbery of vulnerable elderly man in the home. Acquitted.

R v Vassell (G)

Prisoner charged with arson with intent to endanger life. Guilty plea, community sentence passed.

R v Soper

Young woman accused of a ‘glassing.’ Acquitted of wounding with intent, sentenced for wounding.

 

Privately funded matters

Andrew is regularly instructed by City firms in respect of privately funded matters for professional people. Examples of recent instructions include a charge of death by careless driving (sentenced to a fine following guilty plea) and the attendant Coroner’s Inquest (finding of accidental death); a charge of failing to provide driver details in respect of a fleet of cars (acquitted); and a charge of harassment by means of drunken abusive text messages and assault of the defendant’s common law partner (to be heard in Luton Crown Court).

 

Prison Law

Andrew advises in relation to, and regularly appears in, Parole Board hearings. Examples of recent cases include a juvenile murderer released at tariff; a convicted murderer moved to open conditions; a convicted murderer granted an oral hearing following an appeal denying him parole; a serial rapist, released on license; and other offences meriting a life sentence or an IPP. Andrew also provides advice for judicial review and appeals of administrative decisions on technical aspects of prison law, for example: sentence calculation, categorisation, health care, and license conditions.

 

Lecturing

Andrew delivers lectures for professionals on a variety of different topics accredited under the Continuing Professional Development (CPD) scheme for the Law Society. He has lectured for BPP and MBL seminars in respect of Prison Law, Hearsay, Bad Character, Expert Evidence, Vulnerable Witnesses, Confiscation and Road Traffic Law.  He has presented lectures for conferences for the Solicitors’ Group on a variety of topics.  Andrew has presented telephone-based lectures for clients and has conducted in house training for solicitors.
